It depends on what the money was for. If you get a settlement, make sure whoever drafts the settlement itemizes out what the money is for. How much for injuries, if any. How much for lost wages, if any. And so on. It's only community property if any of the money pays for things that were already paid for by community property. If you had personal injuries and community property money was used to pay your doctor's bills, then part of the money should be used to reimburse the community. You should seek advice of an attorney over the specifics of your case.
