Legal Question in Family Law in California

He wont sign the papers

I've been married to my spouse for 4 years. I want to get a divorce now cause things are not working out. We have nothing together no property, no kids, no bank account, no loans nothing. I gave her divorce paperwork to sign and my spouse said that it will not be signed unless a lawyer gives it to her. She knows that i can't afford a lawyer. What can i do to get out of this marriage. We are not living together been separated for 4 months and i have no intention of going back to her.

Re: He wont sign the papers

File a petition for dissolution of marriage. Then have her served with the petition. She will have to file a response within 30 days or you can take her default. If she files an answer you can set the case for a trial. You will have to file and serve additional forms to complete the dissolution. Look for a book at Nolo Press or other source to provide the additional information you will need.
