Legal Question in Family Law in California

Signing The Birth Certificate

My spouse has a child by someone else. When the child was born my spouse never put the biological partners name on the birth certificate, a few years later, my spouse has the idea of now just putting my name on the certificate, would this be okay?

Re: Signing The Birth Certificate

Based on the limited facts you provided it would appear that the best approach is to obtain a court order that you are the father. A petition to establish paternity would be filed and you would agree that you are the father. The court would then enter a judgment that you are the father. This response assumes that you also wish to be named the child's father. If you do not want to be the child's father you could then demand a paternity test. If you are excluded as father then you will not be put on the child's birth certificate.
