Legal Question in Family Law in California

signing husband's name on checks to pay bills

My daughter's husband has threatened to divorce her and send her to prison for writing checks on his bank account and signing his name when she paid their bills.

She started doing this two years ago. She claims she had his permission to pay the bills from his account, but he had refused to have her put on his account.

He lost his job a month ago and the money in his bank account is running out. He is now accusing her of forgery and stealing from him when she wrote those checks.

They have been married 4 years and have always maintained separate checking accounts.

She has a job (at a bank) and has always worked during their marraige. She paid some bills from his checking account and some from her checking account.

They have one child.

They live in California!!

Can he have her charged with forgery, etc?

Does she need to take steps to protect herself?

Re: signing husband's name on checks to pay bills

It is very unlikely that the police will take any action in regard to her signing his name on checks. The police usually do not get involved in family disputes of this nature. However, in an abundance of caution she should not talk to the police ore any other party, including parents and family. Retaining an attorney to help her deal with these threats.
