Simple Divorce
My sister lives with me. My family and I moved her in with me when we found out she had cancer. Her husband was trying to kill her with drugs the Doctors gave her for the pain. She has a $120,000.00 life insurance policy. Alls he talked about was what he was going to do with the money.
She now has a Legal Separation from him that states he can't go after her insurance money anymore, but that she has to pay $142.00 a month for his Spousal Survivor Benefits out of her retirement she receives. The court papers say she has to pay this for a period of 18 months. She is retired from Federal Government Service. This time frame ends as of Sept. 1999. Then the ex-husband is suppose to re-imburse her the $142.00 every month. This is something we know he Will Not Do. The Government said to end this ,
she should get a divorce.
Now, my question is: Can she go thru a paralegal to get this divorce, or should she have legal counsel with her?
The court papers she has now state that neither of the parties can go after each others possesions or retirements. I hope that you can give us some advice on which way we should pursue this matter.

Your sister should be represented by an attorney. A paralegal cannot give legal advice.
