Legal Question in Family Law in California
is their help for my situation
my husbands ex-girlfriend lives in CA and lied to welfare and told them he wasn't paying child support. But he was paying support in NC and CA, it was being deducted out of his paycheck each week. Now CA wants him to pay welfare back of 11,000.00. do we need to get an attorney from each state, or one attorney for both?

You need to file a motion to determine over payment or under payment of the support order. It sounds like California would be the place, however, it is not possible for me to advise you as to what state to do this in wihtout first reviewing all of the documentation involved.
I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

Re: is their help for my situation
I would start by retaining an attorney in California and let him/her advise.

The information provided is really not sufficient to fully determine the correct State in which to file. The Support services here in California is probably working in tandem with the Support Services in your state. I believe it would probably be reasonable for you to file papers here in California to determine arrearages, if any, establish a proper support order and prevent this matter from deteriorating. As you are probably aware, arrearages accrue exhorbitant amounts of interest and it behhoves you to act quickly to stop the Support Services levying further amounts against you. If we can of assistance, please feel free to contact us. Regards, Damian Nolan.

You need an attorney in the County that is attempting to collect the child support. Your husband should not have a problem, but his ex-girlfriend is in deep trouble for welfare fraud. The attorney will need paystubbs or payroll records from your employer showing the child support payments that have been made. Be careful not to submit to the jurisdiction of the State of California without consulting an attorney, you could be causing real problems. There should be only one child support order. You would most likely need the assistance of a CA lawyer to make inquires as to underpayment/overpayment. I may have an alternative solution to trying to retain an unknown CA lawyer, though. If you would like information, please e-mail me at
