Legal Question in Family Law in California

Slander

My husband has had custody of his 2 children for the last 10 years and has been receiving $100./mo. child support. A support modification has been granted and now she decided that she wants custody of the children. She and her mother have declared under oath that my husband and I are drunks and constantly abuse the children. I have never drank alcohol and my husband has gone through rehab. Neither of us has ever spanked much less abused the children (we have plenty of witnesses to that fact). My question is ''Can I sue her and her mother for slander on my part?

It appears that the case is in california, and that the statements were made in documents filed with the court. If this is an accurrate statement of the facts then the statements are privileged, and you cannot sue for damages. You husband may wish to ask the court to seal this portion of the court file.
