Legal Question in Family Law in California
Sleeping Over At Boyfriend With Infant
My ex and I have been apart since before we found out I was pregnant. We now have a 3 month old daughter,(and 7 yr. son) myself having primary physical custody. (I breastfeed...) I have agreed to let ex come over almost every day for 2 hours to visit, I go to his house (where he lives with a female roomate, his fourth in a few years) twice a week every other week. So far so good. However, I have recently began a relationship with my best friend of seven years. He is a great guy, clean lifestyle. Every Sat. my ex takes our 7 year old son overnight, and I have take the baby overnight to my boyfriends. She has her own bed there and I am just as responsible for her there as at home. My ex is jealous and threatening to take me back to court over this. Could he get our baby overnights on Saturday based on this? When do courts in Cali. give overnight rights to a father of breastfed baby? She won't take a bottle yet. Thank you so much.

Re: Sleeping Over At Boyfriend With Infant
Your situation has too many variables to give any realistic opinion. Much of the decision will depend on the judge. Breast feeding will not always prevent an overnight, as milk can be pumped and stored for later bottle feeding. It sounds as if you and your ex have worked out an excellent child sharing plan and I would see not reason to change it, at this time. But that is just my opinion, based upon one side of the story. Many judges could have many different opinions. Good Luck, Pat McCrary
