if Social Security has declared one parent disabled does that constitute incompetent? can I use Social Security as a witness against the other parent?

I guess that would depend on the declared disability. Unless it's psychological prevents them not only from working but from basic life functions, you won't get anywhere. And by the way, this is not a game to be won. Your child's life is literally at stake, because how you handle custody and parenting together will decide what kind of life your child will have until they are 18, and really well beyond that. Turning your child(ren) into a battle trophy is about as evil as anything in the world.
