How do I get sole custody of my daughters from my verbally, emotionally and sometimes physical abusive ex-husband?

If you have proof of physical violence on or in front of the children, file for a restraining order and then a motion for sole custody. Otherwise, file a motion to change custody and make your case and hope for the best. The court will decide what is in the best interests of the children, but bear in mind that absent violence on the children, or serious neglect while in his care, taking away all custody pretty much never happens.

What is the current custody order? On what circumstances was that order based? Has the facts changes? What has changed? What evidence do you have to submit to court? Has a custody investigation been undertaken? Was there ever a police report?
