Sole custody of a minor

My exboyfriend told me he would be willing to give me sole custody of our son. He has not been an active part of our sons life since his birth, six years ago. For my own peace of mind I have always considered going for full custody but didnt want to put my son through the process. Is it at all possible to file for sole custody without having to go to court, since he is willing to give it to me. What rights will he have if he does go ahead and give up his custodial rights?

Giving you custody can be done simply by stipulation which does not require a court apearance. Since you were not married, you need to establish your ex as the father but you do not have to "drag" your son through much at all unless there is a fight.
