Sole custody no visitation
The mother of our son has not had any visitation rights or custody for quite sometime now (it was at my discretion and I allowed it several times supervised- then withdrew due to innapropriate pareting -again). Do the grandparents (maternal), have the right to demand phone calls to be returned immediately or to make plans to get the grandchild?Visitation has taken place more than several times in the last 6 months and many of the times they let our son see his mother when I have asked them not to do this. What is the latest Supreme Court law regarding: Granparent's Rights for California? Can the mother continue to call and leave messages for our son after I have told her to not call? To answer your questions concerning visitation and custody rights for grandparents and mother you would need your court order reviewed by a custody attorney. The US Supreme Court severely limited grandparent visitation rights, however, the California courts have not followed the decision except minimally. Bottom line, you have the right and responsibility to protect the child, but you should be familiar with what the local court would do in the current situation. Get a consultation with an attorney.
