Legal Question in Family Law in California

sole legal custody fraud

In short. I knew my ex lied, the mediator took her side and the court adopted to recomedation and I wanted to prove the evidence I knew that she was lying and the children had needs that should be addresses ie meds homework ...and we were set for trial then the judge awarded my ex 10k from me for her atty fees because they said I was not settling. I paid it . Then my father became ill and I settled with a stipulation of we go to a counselor for the kids to see to the medication and educational needs , but my ex has not done any thing about it. Seem like the judge just belives her.

But now I just got some new documents that were subpenda and they show that my ex commited child care welfare fraud with her mother as the care giver. They claimed child care on my custody days and even when my kids and I were even out of the state for 9 days. I am going to report her to the agency for fraud .. My question is that can I go back to court and ask for sole legal custody if she is arrested because she used my kids for fraud and also and ask the court for reversal of the 10k because she brought fraud upon the court by lying to the medator and now I have the proof that I did have a real case and supports what I sai

A motion for new trial or reconsideration is difficult and has time limitations. You must act immediately and it is unlikely you can do it without an attorney. Consult an attorney immediately with all of your documents. Good Luck, Pat McCrary

Re: sole legal custody fraud

it seems you and the bench officer are on two different pages. do you have an attorney? i doubt that mother will lose legal custody because she engaged in fraud. i doubt that the court will reverse its attorney fee order, but i could be wrong. you might want to hire an attorney and work out a strategy to accomplish your objectives.
