How can I get sole legal custody of my son?

I have been a single parent for 5 1/2 years. My son's father abandoned my son two months after he was born. He recently came back into the picture when my son was 3 1/2 years old. He pays child support regularly now, but visits or calls maybe twice in a year. I never went to court to legally get custody. Do I have sole legal and physical custody? or do I have to go to court to petition for this? My ex becomes upset sometimes when he feels he's paying too much child support and threat to fight for custody.

It is very important you go to court for a custody order otherwise the father has as much right to custody as the mother. Michael Hall Gray
