Legal Question in Family Law in California

i have sole legal and physical custody of my 12 year old son. According to our MSA father has visitation for 14 hours each weekend and half days on b-days and holidays. Since the final judgment in January of 2010 he has never made legal moves to get more time/custody. He is also supposed to pay 50% of the children's medical and educations costs (no guideline support) but has paid nothing. He has no job and place of his own to live.

I want to move to Florida (currently reside in California) to live with my boyfriend. I have a terrific job lined up out there and it will greatly ease the current financial burden i have living here in California (where i happen to have a good job also!). What are the chances of me being able to do this without there being any extraordinary change in circumtances?

Ask father to sign an agreement allowing you to move to Florida. You should propose a visitation plan. Your son may be old enough to fly by himself to come to California for a visit. At this time airline tickets purchased in advance are very reasonable. You should consult with an attorney to have the agreement properly drafted and then have his and your signatures notarized.

If he will not sign such an agreement then you will have to file a motion in court for an order allowing you to move to Florida.
