I have an open child support case, my son is 3, and the father has never paid child support until recently i got 2 checks, he thinks because he just started paying he has joint custody. i want to file a papers to get sole physical custody of my son, have him sign up all rights, but keep child support. can that happen? he hasn't see or communitcaed with my son ever. but because there is now a garnishment he is upset they are taking money. what do i do? i am soo stressed out. i even offered him at one time to sign up rights and give back some personal property of mine and i would give up child support. he won't do it. please help. i have so many questions and no one will help me at all...

What you are requesting is sometimes possible. Generally though the courts would prefer the child have a relationship with their father even if the mother does not want that. If you want some more help please contact me at your earliest convenience.
