Legal Question in Family Law in California

My son was born in 2011, there is no paternity established between him and his father. We were broken up from pregnancy, until 02/13 when we got married in california. Last week he took off and never came home apparently went to Colorado & I have not heard from him since. If I file for divorce will he get any custody or visitation since we were not married when my son was born & he never signed the birth certificate? Will my son even be broughten up if no paternity is established?

Unless he files a petition to establish paternity in connection with or in response to the divorce filing, your son would not be involved at all.
