Legal Question in Family Law in California

Son doesn't want to see father anymore

I have legal custody of my 15 year old son. His father gets him every other weekend and one month every summer. At what age can my son decide to not see his father at all anymore largely due to verbal abuse.

Re: Son doesn't want to see father anymore

Courts insist that court orders be followed. Until his 18 the court order for visitation applies. As a practical matter you don't have to force him to go, in fact how can you force him to go for the visit. You should file a motion to modify visitation. This will allow you to present the matter to the court. It would be unusual for neither the court and the evaluator to not speak to him about the visits. The other alternative would be for father and son to meet with a family counselor, with experience counseling children and parents. Meeting under these circumstances should result in a improved relationship between father and son.
