Legal Question in Family Law in California
Son doesnt want to go with Father
My son has just turned 12 and his father has primary physical custody of him. We share joint legal and my son comes to stay with me and his brother every weekend and a couple days of the week. My son has stated to me, his father and his paternal grandmother he does not want to live with his dad or does he want to go to the school that is near him dad's home. He has stated he wants to live with me and go to school here. Is there any way around this besides court? We have never had a good experiance with our court system here. I would like for this to resolve itself. My son thinks that if he does't want to go, why am I making hime go why can't they just change without going to court? Please respond as quickly as possible. My son and I are wanting this to be over with before he has to return to school after the winter break.
Thank you

Re: Son doesnt want to go with Father
th easiest way to accomplish your goals here, without a "messy legal or court battle" is for you and your son's father to amicably agree to a modification in physical custody. this would effectuate your goals in a far less aggravating or costly manner. you may want to speak with an attorney to help all parties negotiate such a modification or even act as a mediator. if you would like a free phone consultation on this matter, email us directly with your contact information today.
