Legal Question in Family Law in California

My son is only 17 and girl friend is 16 they just had a baby one month ago. My son has never denied the child and loves the girl friend and wants to marry her,but we are making him wait. The girls mom is wanting to move out of state with the new baby, which means my son which is a very involved dad won't get to see the baby until vacations only. What do I need to do or does my son have any rights at all?

If your son does not want the mother to move out of the state, you need to file a court action immediately to get a custody order so you can have routine visits with the child. If the child is allowed to move away you will be in a situation where you have lost custody.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
