Legal Question in Family Law in California

My son is currently incarcerated and will be out September 20 1 4. He and his girlfriend have a two yo together. They lived at my house some of the time and the other at her parents home. While my son has been locked up, his girlfriend died. The baby has been living with her parents and stays with me quite often. DCFS just informed them there inolegal guardian and if they don't take care of this they will take the babY to foster care. My son should be getting papers to sign that gives custody to his girlfriend`s parents very soon. If he does sign her over,, does that mean he can't have custody when he is released? Can it be a temporaRy order? What are his rights, as he will want custody of his daughter when out.

Any guardianship he agrees to should be temporary and a review date on custody should be set for hearing after his release. Your son needs an experienced family law attorney to assist him on this matter.
