Legal Question in Family Law in California

My son and I have lived in San Diego, CA for 6 years. My ex-husband has not paid child support for 3 years and has never followed the court order for supporting our son medical expenses. Before the 3 years he was only paying half of the ordered support. We share custody of our son. Can I have the San Diego court order payment of arrears even though the child is almost 18 yr old? He will graduate the second week in June> The child support order is fron Georgia which is the ste we were married in.

You need to get a move on. You most definitely can have the GA order enforced in CA, but it would be enforced under GA law. You also can only have CA enforce it if the ex is in CA. Orders have to be enforced where the person subject to the order is located. You should start by contacting your lawyer in GA to get the ball rolling there. You will need to start with a current GA order for arrearages. Then you enforce it wherever he is. There is a process where you could have the whole case moved to CA if the ex is no longer in GA, but that really would be a waste of time and money with a child about to turn 18. Better to just get a current GA order, and enforce it wherever the ex is.
