Legal Question in Family Law in California

son no longer wants to live with dad

My son is 11 years old, his father has primary custody and we joint legal custody, he spends time at both homes but the majority at his dads. He no longer wants to live there or go to school there either, He has shared this with me, his dad and step mom and his grandma (dads mom). I have spoken to his dad about his wants but his dad doesnt care, he tells my son it will never happen. What do I need to do?

You will need to file an OSC requesting a modification of child custody, visitation and support.

I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

the proper procedural approach here would be to file for an OSC hearing with the court of jurisdiction in order to present your request for a modification of physical custody of your child. if you would like a free phone consultation regarding this matter, email us with your contact information today.
