Legal Question in Family Law in California

My son is 12 and wants to move home with me. His mom wont let him move home for what ever reason (ie. Child support) but in the mean time argues with him regularly. So far she�s threatened to kick him out of a moving car, told him he wasn�t able to live with her anymore and could leave to my house, dramatically opening the door � only he had to leave naked because he couldn�t take anything she paid for. Despite orders by the judge to take counseling and NOT demean me to the kids, she didn�t go to the courses and constantly belittles and disrespects me to my son , who has stated he doesn�t want to live with her anymore. What are my options?

If the child is suffering abuse from his mom, it may be appropriate for child protective services to assess this situation. Threatening to kick the child out of a moving car and telling him he could leave to go to your home with none of his belongings as well as without clothes is abuse. You should consider filing a motion to change custody based on the foregoing circumstances.
