Legal Question in Family Law in California
My sons father an I have joint custody. My sons father has physical custody of my son because he had my son in his possession at the time of court. We went through a 5 year custody battle. My sons father was in Philadelphia for the past five years. He recently moved Atlanta, but he dropped my son off in Arizona to his Grandfather house. I live in los angeles. Do I have to file an ex-parte before I go and get my son or can I go get him from his grand father first? The court we attend is in los angeles.

I would need to look at your court orders to advise you. I am not sure what you mean by dropped him off with his grandfather. Is that a very temporary situation, or dad intends for him to now live there? You should get this changed through the courts if so, and get the support you will need. The information you have provided is insufficient to give you a considered response. We would need to see the orders currently in effect and determine that the court in Los Angeles retained jurisdiction. Presuming the LA court does indeed have jurisdiction then I believe it would be in your best inerest to contact an attorney to assist you in having your child returned. These matters can involve complex litigation and an experienced attorney can be of very great assistance. Please feel free to visit our web site at losangeles-orangecountylawyer.com
