Legal Question in Family Law in California

I need to have my son's father served for joint custody but I don't know where he has been for the past three years. He has had my son all this time. Is it legal if I put an ad in the paper that we are to be in court this month? If so, how long does it need to run in the paper and how long before hte court date is he to be notified?

I might suggest that you go to the district attorney and see if they have a child abduction unit or child locating unit. I haven't done it for a while, but there is a procedure where you can get the judge in your case to order the District Attorney to locate the child and father. Good Luck, Pat McCrary
