Legal Question in Family Law in California
My sons father has supervised visits once a week at a court appointed organization. He has canceled visits, ended visits early and multiple times just didn't show up. Yesterday we went to court and the organization overseeing the visits is suppose to include this in the report they submit to the judge. However, the report did not include any of this vital information it only had comments about the 2 visits that actually happened. The father didn't bother to show up to court either but with no proof that the father is not coming to his scheduled visit the judge ordered an additional 2 months of supervised visits. I no longer have trust in this organization and want to know if I can have them sign something at each visit that would prove if a visit takes place or if it is canceled?

I recommend meeting with the head of the organization and getting an explanation of their reporting system. Second, you know what is or is not happening. This means that you should document each scheduled visit, whether it happens, whether it ends early or other relevant factual information (which is not how did you feel about what was going on). Your record may be used, with proper documentation as additional information to the Court about your child's father's conduct. I also recommend that you consult with a family law attorney about how to prepare a declaration to the court to support your information.
