Spousal Abuse defense

My wife and I had an argument after arriving home from a night out. We both inflicted minor physical injuries to each other during the argument. The neighbors called the police, who later arrested me for spousal abuse. My wife does not wish to press charges. I have no criminal record. The Police took pictures of both of us, and of our 2 year old son who accidentally received a cut on his leg during the incident. Do I trust my future to a public defender, or do I pay enormous amounts of money to an attorney who can help me get these charges dropped? Please help. Thank you.

The choice is obviously up to you. Many, many public defenders are very good at their jobs and they usually have close, working relationships with the Assistant DA's and judges in the courthouses where they work. If you have enormous amounts of money, then you are not likely to get a Public Defender. I say meet with your Public Defender-if you can get one appointed to represent you-and see what they say. Do not make a decision as to your defense, and then interview private attorneys-Martin

Let me expand your question just a little bit. Do you trust your future, your wife's future and your son's future to a public defender, who has a priority of getting your case out of the system and the easiest way is to get you to plead guilty to a charge the will change your life and your families? You may pay a lot to a private defense attorney, but you get what you pay for and if you pay nothing for a public defender you will get what you pay for. Good Luck, Pat McCrary
