spousal pension rights

my husband of 20 years took the money out of his pension without my knowledge and opened an individual IRA. He will turn 591/2 next week and plans to cash it in. How can I prevent him from taking all the money and leaving me with nothing.

You can file a petition for either a legal separation or dissolution of marriage, as serve him with the summons and petition. This will prohibit his removing the money from the IRA. This is the simplest and most certain way of getting a restraining order. Consult with an attorney to discuss the options available to you.
