Legal Question in Family Law in California

spousal support definitions

I am under the understanding that I have to pay spousal support to my soon to be ex-wife. I have the judgement that I have physical custody(72%)and she has visitation(28%). My wage is aprox 10 dollars per hr more than hers. Are bonuses and overtime part of wages? Does support have to be figured on annual gross? Year to date? My concern is that I will have to pay support Based on bonus and overtime last year that may not be availabe in the futur.

Re: spousal support definitions

Spousal support is based on your ability to pay and her need for support. Ability to pay is base on your annual income. If your employer will give you a statement that you will not be receiving a bonus or overtime during the next 12 months. Also you can request to set spousal support on your base salary and then review it annually to determine if you should pay more support based on your overtime and bonuses.
