Legal Question in Family Law in California

spousal support

My divorce was final in 2003. For sometime I lived with my boyfriend, we have since broken up and I am living with my children at this time. My ex-husband stopped paying support shen I moved in with the boyfriend. He did not take me back to court to stop the order, he just quit paying. Can I take him back and have him ordered to begin paying again?

Re: spousal support

Yes, you can go enforce the order, and your ex owes you for all the missed payments. Living with your boyfriend would have been grounds to change the spousal support order, but the order can't be changed prior to the filing of the request to change it. So your ex owes you whatever he hasn't paid, and there can be no debate about it.
