What would be legal defenses to prevent a 40 year old unemployed male freeloader from receiving spousal support from a retired, older wife?

Re: spousal support

Spousal support is not given if the spouse is capable of employment

and has not taken reasonable steps to become self-supporting. Also, the length

of the marriage, the standard of living during the marriage, and the income

and needs of the supporting spouse are also considered.

The above are factors in the determination. Defenses to spousal support itself

would be a void or voidable marriage, remarriage of the supported spouse, or certain

situations in which the supported spouse is supported by a live-in

significant other and does not need support.
