Legal Question in Family Law in California

Spousal Support

I was ordered by the court to pay spousal support to my ex-wife. Last month she told me that she is pregnant with her boyfriends baby. Am I still legally required to pay spousal support since she is pregnant by another man? A man she has been living with for a few months now. My divorce was final, but I have to go back to court on Feb. 29th because we can not agree on the spousal support. I don't feel I should have to pay anymore since she is pregnant.

Re: Spousal Support

since she is cohabitating, the amount of your support may be significantly reduced.

Re: Spousal Support

The court can take a lot of things into consideration when deciding whether to order someone to pay spousal support. I would tell the court these things. I don't think the court would order you to pay spousal support, taking into consideration the fact that she has been living with another man and is now pregnant by him.
