Spousal support

I am currently paying spousal support. It comes out of my child support. I am headed to trial in one week to fight this. I have Physical custody of my four children and have 80% custody. He gets them every other weekend. I also have a documented domestic violence record that he was arrested for during our marriage. I am also paying all of our community debt, and we have been legally divorced since July of 07. He has not paid anything except his court ordered child support since 10/06. Does it sound as though I have a leg to stand on to get this spousal support put on reserve or just not even allowed any longer? And what are my chances of the judge ordering him to pay all the past community debt that he has not paid, including bills to the IRS and the State of California... Thanks.

These are questions for which you need an attorney. This is not the type of question that can be answered on this forum. For instance, what was the court order for spousal support? Why were you order to pay all of the community debt? Why do you have custody, yet "80%" custody? How long ago were you divorced that you claim that during marriage, he was arrested for domestic violence? There are many more questions. You need to seek counsel.

I would agree with Ms. Healy. There are many, many questions that must be first answered before anyone on this forum could possibly answer your questions. Seek out a family law attorney for your matter.
