Legal Question in Family Law in California

Spousal Support Payments

How long does one have to pay spousal support if a couple has been married for 20 years and has been paying support (court ordered) for 4 years? The wife works and has a good job and is totally self-sufficient.

Re: Spousal Support Payments

Spousal support payments are not easily reduced to a formula or time restrictions if the marriage is over 10 years. A marriage over 10 years is a long term marriage and spousal support will not necessarily be terminated, but could be, in the sound discrection of the judge. She may be self supporting, but is she self supporting to the marital standard. You need to talk to an attorney in your area who will know the judge the will be hearing your case. If she is earning more now than when she was 4 years ago, there may be a reduction, there may be a termination date set. It is a decision that will be made by a judge which is very dependant upon all of the facts, including the marital standard (the standard of living during the marriage) her income and your income. Good luck
