Legal Question in Family Law in California

Spousal support

I was receiving spousal support until my husband lost his job. I was married for 10 years and didn't work. If I get a job will I have to pay him spousal support? When he has a new job will he have to notify his attorney so I can get my spousal support again? Will he have to backpay me for the months he didn't pay? Thank you, Gail

Re: Spousal support

If there is an order for spousal support, it doesn't change just because he's lost his job. It only changes when he sets a court hearing to so change it. Typically, the judge will set a date a few months out to review whether or not your husband (ex?)is working again and then will again set support. If you get a job that pays sufficiently well, it's possible you would be ordered to pay some support while your husband is out of work, but again, nothing just happens, you have to file the correct paperwork and set a court hearing.
