Can a Spouse file for Child Support even if they are not legally divorced, but a divorce has been filed and has not gone before a judge in the State of California?

Yes, you file an Order to Show Cause (O.S.C.) for custody and support or you go to the Department of Child Support Services to get them to open a case for you.

Of course. You don't have to wait until a divorce is final, sometimes years after it is filed, to get a support order. It is not only allowed, it is totally normal to have temporary support orders in place within weeks after the divorce is served on the other spouse. Sometimes you can even get it within days if it is an emergency.
