Legal Question in Family Law in California

My ex spouse and I were married for 23 years. I still have a 14 yr. old at home. My ex has been making $500K+ per year for the past 10 years (while wwe were married). He recently married an extremely wealthy woman and quit working and plans to pay me nothing since our support payment was based on his actual income. What is my recourse? ANy case law? Thanks,

1 Answer from Attorneys

You ex is going to be disappointed in his plans. The court is not going to modify his child support/spousal support obligations based on his voluntary unemployment. The court will rely on his earning capacity instead of his actual earnings. If he files for a modification contact an attorney immediately. Depending on your circumstances you may be able to have your ex cover your attorney fees.
