Legal Question in Family Law in California

If my spouse has primary care of his daughter, and he leaves the country to take care of his legal status, and the mother of the child wants to take him to court, could I hire an attorney to represent him in court in his absence? And can the mother take the child away from me before they go to court?

Yes, you would NEED to hire an attorney if he cannot be there. They would have to get a court order to take the child. Theoretically they could go in and ask for one on an emergency basis once they know he has left the country and left her with you. Whether it would be granted or not depends on too many factors to address in this kind of Q&A.
