Spouse refuse to pay for her share of bills

My wife and I are in the middle of a divorce, and she had moved out of the house. She is being very difficult and is refusing to paid for any bills we owe together. The one I am most concern about is the car insurance bill, she has in her possession one of our cars, and has been using it exclusively for the last half a year. Well, the bill finally came, and I ask her to pay for the insurance for her car but she just ignores me. Can I just call up the insurance company and drop the coverage for her and the car? How about bills for our kids? I'm just not sure how these things work. Thanks for your time.

Based on the facts you gave it appears that your name is on the title to the car she is using. Dropping the insurance on that car would expose to the potential of being financially liable for any damages that may result from the operation of the vehicle.

Also the court would take a dim view of your canceling the car insurance. The best approach would be to seek a court order that she pay the car insurance. You should consider removing your name from the title by transfering the vehicle to her in her name alone.

Maintain the car insurance until you have taken steps to protect yourself and obtaining a court order that she pay the insurance.
