Legal Question in Family Law in California

My spouses anger continues to grow, on top of being verbally and emotionally abusive he throws things and kicks doors in. If i were to take my 20 month old son out of the house until my spouse cools off is that considered kidnapping or child abduction? Would not put it past my spouse to call the cops on me if i left until he cooled off.

I agree with Ms. Kock. Actually removing yourself and the child from the home during your spouse's fits of intense anger is appropriate given that remaining in the home could subject you to child endangerment charges. As has been recommended, you need to get emergency protective orders for yourself and the child. Good luck with this.
