If they are on the deed of trust, I am cofident that they have some legal interest in the house. What interest it is, and to what extent is impossible to say with the lack of details you provide. It is also quite odd that they would be on the deed of trust but not on title to the house. That alone requires explaining before any inquiry into what interest the spouse might hold.
