Legal Question in Family Law in California

ssdi how affected when divorce

does alimony payments affect ssdi monthly payments? If ssdi is reduced, would ex-spouse have to make up the difference since the ssdi is used in the calc of the spousal support? my daughter is also paid from my ssdi because of my disability and inability to earn as much. will he not have to pay child support because she already receives support from state? if so, then to be fair to all, and return monies to social security fund, should i just cancel that benefit so that he must take responsiblity for his daughter and pay child support?

Re: ssdi how affected when divorce

This is primarily a tax question and assumes knowledge of federal benefits. You can call the Social Security office or make an appointment at their office, or obtain a bulletin/flyer available in their office that explains these benefits.

As to the support issues, there is not a clear statement of how much support is being paid and by whom. There are many factors in the calculation of child and spousal support. There is a big difference between temporary spousal support and ongoing spousal support after a long term marriage.
