Legal Question in Family Law in California

SSI - SSDI & child support?

My friends son has some serious mental problems and he has been recieving SSI & SSDI for years. He now has a child with a women he has been with for a good 4 yrs but they are spitting up.

My buddy told his son to try to work things out with this women because in the long run its better for the child involved. The girlfriend some how has no idea he is on SSI & SSDI. He has hide that from her this entire time. She thinks he works under the table some place. She told him she will be going after him for child support but he told his dad that the courts won't take child support from his since he is receiving SS benefits. Does anyone know if they can get child support payments from someone on SSI & SSDI? (I told his father I believe they can and will as it should be.) But I could be wrong.

Re: SSI - SSDI & child support?

25% of SSI and SSDI payments can be attached. The court can also order more than that amount, but it cannot be attached.
