Legal Question in Family Law in California

I dont know how to start I just want to be legally divorced without the drama. I'm asking my husband for help and come to an agreement. I dont have a stable job and I have the 2 car payments, and credit card that we used for a family vacation. I asked him to keep 1 car and pay that credit card because thats what he said he would do. He doesnt want to help me with that what can I do? Also he threatens me to take my twin daughters away when I am a good mother, I dont drink alcohol or use drugs I'm with my daughters all the time and he is not around not even on weekends. I ask him for child support and he says he wont help me either. I dont know what to do I cant afford a lawyer or a place to live what can I do?

Many people in your situation handle their divorce themselves. You can force him to pay half the debts, and you can get help getting child support. He cannot take your children away from you if you are a good mother. The court will decide on a custody and visitation schedule if you and he cannot agree, that will give time with each parent. I recommend that you pick up a copy of How to Do Your Own Divorce In California, by Nolo Press, and look it over. It has very clear instructions on how to do a divorce. Then contact the Department of Child Support Services. They will help you with the child support part of the case. Lastly contact the Family Law Facilitaor's office in your local Superior Court about what clinics and help sessions they offer. If your husband decides to fight tooth and nail, however, you will need a lawyer. If your husband has income and you do not, however, there is a good chance the court will order him to pay some or all of your attorneys fees. You, however, can expect to be ordered to find regular employment too. Hope that helps.
