Legal Question in Family Law in California

start visitation rights

To whom it may concern:

Hello. My boyfriend has a son who he has been paying child support for. Unfortunately, he has not seen him. But now, he would like to start seeing him. How does he go about this? Will the courts let him have visitation rights even though he showed no interest in exercising his visitation rights before? Thank you very much for your time.

Re: start visitation rights

He has a legal right to see him, but it's important that he's reintroduced into his son's life in a way that won't upset the boy. He can either work something out with the mother of the child, or if she's not willing to discuss it, he can file a motion for visitation in court.

Both parents may want to talk to the child's school counselor, teacher, pediatrician, or a therapist to discuss the best way for dad to come back into the child's life.

Good luck!
