Legal Question in Family Law in California

Starting the divorce process

What's the best approach to take when filing for a divorce? I've been married for 7.5 years and have a 3 year old and contemplating getting a divorce. I would anticipate the process to be difficult, particularly with child custody. Should I communicate with her about a divorce or start the paperwork first? If she leaves with my son after finding out, what's my right as far as custody and how quickly will it go into effect? I'd appreciate some feedback from some experienced lawyers in child custody.

Re: Starting the divorce process

you have the right to custody and visitation of your child regardless of where the mother lives. since your child is 3 the courts will probably give mom more time, but as the child gets older you will get more time.
