Legal Question in Family Law in California

Out of state child custody

I am a California resident and Im going to marry a woman from Florida. She has a child, and the father

to whom she was never married to has never gone to court to establish paternity (but who's name was later added to the birth certificate). Can we file for custody in California or will be forced to go back and for to Florida to go to court?

Re: Out of state child custody

Jurisdiction is in the child's "home state." Home state is where the child has been living for the last six months. You can move to California and then wait for the six months to pass.
