Legal Question in Family Law in California

state law re: grandparents rights

I was never married to my daughter's father. His parent's have never had custody. I wanted to find the actual laws as to the visitation rights of grandparents. I heard(through the rumor mill) that California does not have any grandparent's rights in place. Is that true? Either way, were can I find it state as such?

Re: state law re: grandparents rights

The grandparents may seek visitation. There is a specific code section allowing such a petition. Please consult a local attorney in your area. Good luck and thanks for inquiring.

Family Code section 3104 et seq contain the statutes regarding visitation by parents, grandparents and non parents.

Unless the grandparents have established some relationship with the child they could have difficulty obtaining visitation rights.

Re: state law re: grandparents rights

Check family code section 3104 which lays our visitation rights of parents/grandparents, etc. May be problem if regular involvement by grandparents has not occurred. Thanks 800-685-6950
