Legal Question in Family Law in California

out of state vacations with grandchild

I would like to take my son and granddaughter to Maui this spring. While the child's legal name on her birth cert is my son's, she uses her mom's name in school. Is it legal to take her out of state? Do I need her Mother's permission in writing and notorized? If she gets a passport what last name should she use? Could she hyphenate the two last names? The mother and father were never married.

Follow you court order. If you don't have any court orders and your child's mother refuses to consent to the trip, you should go to court before leaving. If you don't, it could be the last trip you take with your child in a long time.
